Focus of EIA	Under Section 46A of the Environmental Protection Act 1990, Fixed Penalty Notices (FPNs) can be issued where householders are causing harm to the local environment by not following the rules pertaining to household bins and boxes. As detailed in the Defra guidance, local authorities can issue a FPN when householders do not follow the waste collection rules and their failure to comply when household waste bins and boxes: · cause, or is likely to cause a nuisance, or · have a negative effect or is likely to have a negative effect on local amenities Examples include: · When a bin or box is causing an obstruction, forcing pedestrians and people using wheelchairs or buggies to walk on the road · When a bin or box restricts access to the pavement or street by being left out for several days · When a bin or box is likely to attract vermin, such as leaving bags or open bins out for many days before a collection is due

Age	Data is not held on the age of service users, but some may not be able to return their waste receptacle to a private outdoor space due to age.	The consultation feedback highlighted that some service users may not be able to return their waste receptacle to a private outdoor space due to age.	Consideration needs to be given to those unable to return their bin to adequate private outside storage space. This new approach will reduce the risk of injury for people with mobility issues due to age, caused by trip hazards or the need to enter the carriageway to get around receptacles.	If, upon receiving a written warning as per stage 1, a household is unable to comply with the request to fix the problem due to a Protected Characteristic, they can write to environmentenforcement@brighton-hove.gov.uk setting out the reasons why they are unable to fix the problem, with appropriate evidence. The Environmental Enforcement Team will review on a case-by-case basis. The council can provide an assisted collection to a household who cannot put their waste on or by the pavement and does not have anyone who can do it for them.

Assessment of overall impacts and any further recommendations
Some Groups will not be able to return their receptacle to their adequate private outside storage space. The Environmental Enforcement Team will review this on a case-by-case basis and an assisted collection is available for people who need help to put out and take in their waste, and have no one else to help them. The updated Environmental Enforcement Framework will reduce the risks to all pavement users caused by obstructions on the walkway, i.e. trip hazards or the need to walk in the carriageway to get around receptacles.
